    1. Background

    These Terms and Conditions apply to the hiring of services provided by Pinky’s Events.

    2. Definitions and Interpretation

    2.1 In these Terms and Conditions:

        • “We/Us/Our/Supplier” refers to Pinky’s Events.
        • “You/Your/Client/Hirer” refers to the prospective client wishing to hire our services.
          By using our services, you confirm your acceptance of these Terms and Conditions.

    2.2 “Booking” means your reservation for our services.
    2.3 “Booking Confirmation” means our acceptance and confirmation of your booking.
    2.4 “Contract” refers to the agreement for the hire of our services.
    2.5 “Deposit” is the amount payable at the time of booking to secure your reservation, which may include a non-refundable portion as specified.
    2.6 “Hire Period” indicates the duration for which you will hire our services.
    2.7 “Non-Refundable Deposit” refers to the portion of the deposit that is non-refundable, as stated before entering into the contract.
    2.8 “Price” is the total cost of the services hired.
    2.9 “Services” includes popcorn, candy floss, and sweet cart services.
    2.10 “Equipment” refers to the popcorn machine, candy floss machine, and sweet cart.
    2.11 “Website” means www.pinkysevents.com and any additional websites we own and maintain.

    3. The Contract

    3.1 These Terms and Conditions govern the hire of our services and form the basis of the contract between Pinky’s Events and the Client. If you have any questions about these terms, please contact us for clarification.

    3.2 Information provided on our website, marketing materials, price lists, or other documentation does not constitute a binding offer. Your booking serves as a contractual offer, which we may accept at our discretion.

    3.3 A legally binding contract is established when we accept your booking and issue a booking confirmation. Payment of the price or, if applicable, the deposit becomes due upon receipt of the booking confirmation. Booking confirmations will typically be sent via email unless otherwise agreed.

    3.4 The contract is considered accepted once we issue the booking confirmation.

    4. Our Responsibilities

    4.1 Pinky’s Events is not liable for changes or circumstances beyond our control.
    4.2 All terms and conditions are provided without prejudice.
    4.3 We reserve the right to modify these terms and conditions. Changes will be communicated via email, SMS, or by posting the updated terms on our website.
    4.4 Please review our website periodically for updates.
    4.5 By continuing to use our services after the effective date of updated terms, you agree to be bound by the revised agreement.

     

    5 Your Obligations

    5.1 The following conditions apply to Your hire of Our Services:

    5.1.1 The venue must have the required access, loading area and car parking necessary to allow the Our Equipment to be unloaded, set-up, operated, vehicles parked and Equipment loaded at the end of the event safely. We would advise that You check with Your venue if you are unsure and inform Us of any potential issues including stairs, lifts, distance, specific timings etc. Car parking and congestion charges costs will be chargeable to You in any event. Parking fines will be chargeable to You if incurred by Us where You have informed Us it is permissible to park in a specific location.

    5.1.2 The area where the Equipment is to be set up is clean and clear from anything that may cause injury or damage to the Equipment or participators

    5.1.3 We reserve the right to refuse to perform or operate the equipment if We believe the venue is unsuitable or unsafe, similarly if access causes similar issue We will not be held responsible for any obstruction, nuisance or interference.

    5.1.4 We will require notification if your event is within the congestion zone.

    5.1.5 We expressly exclude any liability for injury loss or damage caused to You or any person using the Equipment contrary to the terms and conditions of this Contract

    5.1.6 You will not use the Equipment for any purpose other than that described in the hiring agreement and shall not sub-hire (without Our express prior written consent, not to be unreasonably withheld) or use the Equipment or allow the Equipment to be used for any unlawful purpose or in any unlawful way.

    5.1.7 We may, in exceptional circumstances and at Our sole discretion decide that the performance / Equipment should be closed down and if this is the case, the full Price will remain payable. Circumstances in which We may exercise this right include (but are not limited to): participants acting in an abusive or aggressive manner to Our operatives or each other; participants are under the influence of excessive alcohol or drugs; the conditions are proving to be too dangerous to continue to safely operate the Equipment.

    5.1.8 Where applicable, You must ensure that a 13amp mains power supply is available unless a generator has been specified on Your contract as required and being provided. If a 13amp power supply is to be used You must ensure that it is within 30 meters from the main power source. Should it transpire that no power supply is available, or the power supply not be adequate to fulfil this contract, then the full Price shall still be payable by You.

    5.1.9 Where in any instance you are supplying power via a generator, you must ensure that an individual is available to relocate and operate the generator as required to ensure that we are able to deliver our obligation to you. Where a generator is being sourced / provided by You, this must be a diesel generator and not a petrol generator. Should a petrol generator be supplied, then the equipment will not be plugged in and the full Price shall still be payable by You for your hire from Us. Details of the power requirements needed can be obtained from Pinky’s Events prior to your event and you must ensure that you inform us at the time of booking, you intend to provide power from a generator (and that this is a diesel generator).

    5.1.10 You must ensure that any users of equipment always use common sense. This includes not leaning against them, pushing or trying to stand on them or any other similar behaviour liable to cause damage to our equipment or other users.

    5.1.11 You must notify Us if there are any underground services, cables or pipes where Equipment is going to be sited.

    5.1.12 No person(s) who are visibly intoxicated through alcohol, drugs or any other intoxicating substance shall be permitted to be in close proximity of our equipment

     

    1. Use of our Services
    • An adult over 18 years old (the hirer /the customer) must always supervise the kids that take part at any events where our services are booked.
    • Any damage to the equipment will be charged to the hirer (the customer) in full, this includes theft.
    • Our popcorn, candy floss and sweet cart services are subject to a £50 deposit to secure the booking. Deposits are NON-REFUNDABLE.
    • Additional deposit of £100 is added on the hire of sweet carts as to cover partly damages. If no damage then £100 deposit will be refunded to the Client by the Supplier.
    • Any misuse of our equipment and any loss of hire arising from misuse shall be deemed liable to the hirer.
    • The full balance of the invoice must be cleared up to 14 days prior the event.
    • Booking our services confirms that you agree with our  Terms & Conditions, and our Privacy & Cookies Policy.


    7 Cancellation

    • 30 days or more prior to event date – no charge of contract price (excluding any non-returnable deposit).
    • Between 14 and 30 days prior to event date – 25% of contract price.
    • Last 7 days prior to event date – 50% of contract price 2 days or less prior to event date – 100% of contract money.
    • If the Company, for any reason, is the cancelling party, the Company’s liability shall be limited as set out in paragraph 5.2 below

    8 Force Majeure

    Neither party shall be in breach of this agreement, nor liable for any failure or delay in performance of any obligations under this agreement to the extent that such failure or delay arises from or is attributable to acts, events, omissions or accidents beyond such party’s reasonable control, including but not limited to any of the following: acts of God, including but not limited to fire, flood, earthquake, windstorm or other natural disaster; war, threat of or preparation for war, armed conflict, imposition of sanctions, embargo, breaking off of diplomatic relations or similar actions; terrorist attack, civil war, civil commotion or riots; nuclear, chemical or biological contamination or sonic boom; explosion or accidental damage; extreme adverse weather conditions; collapse of building structures, failure of plant machinery, machinery, computers or vehicles; any labour dispute, including but not limited to strikes, industrial action or lockouts; non-performance by suppliers or subcontractors.

    9 The Company’s responsibilities

    9.1 In the event of failure of an item of equipment in the normal course of use which cannot be rectified through substitution or repair then the Suppliers liability will be limited to forward hire charges attributable to said piece of equipment/service under this agreement.Such waiver shall be the limit of the Company’s liability in respect hereto and no claims for damages or consequential loss shall be accepted.

    • Nothing in this clause shall have effect to exclude the liability of the Company in respect to personal injury claims due to the Company’s negligence.
    • Any failure or delay caused by circumstances outside of the Supplier’s control is excluded absolutely.

     

    10 Governing Law

    10.1 This agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
